Terms of Use
These terms are the contract between you and the operator of PlayNexa, who is named in the Imprint at https://playnexa.eu/impressum.html (“we”, “PlayNexa”). Contact: contact@playnexa.eu. By creating an account or using the app you accept them together with the Rewards Program Rules and the Privacy Policy.
1. Who can use PlayNexa
You must be 18 or older and able to enter a contract. Do not use the app if you are younger. We may ask you to prove your age and close an account if you cannot.
2. Your account
- An account is created on your phone and is linked to that phone. It is personal: do not share or sell it.
- Give true information, keep your device safe, and tell us if you think someone else used your account.
- You may have one account. Other accounts on the same phone can play but cannot receive cash rewards.
3. What the app offers
Games, quizzes, lessons, videos, missions and surveys, an Activity Progress display, and a Wallet. Some content comes from partners or is shown from other services (for example embedded videos), and their own terms apply to it. We may change, add or remove features at any time.
4. Rewards
Rewards follow the Rewards Program Rules. They are not guaranteed, they can be held, reversed or refused as the Rules say, and they depend on partners and on our available budget. Nothing in the app is a promise of income, and you should not rely on it to earn a living.
5. Ads and partners
The app shows ads. Ads and partner pages belong to third parties; we are not responsible for what they offer or for the sites they link to. Their terms apply when you use them.
6. What you must not do
- Cheat, use bots, scripts, emulators or tampered devices, or hide your location with a VPN or proxy to receive rewards.
- Open more than one account, or trade, sell or rent accounts or rewards.
- Copy, reverse engineer or attack the app or our servers, or look for ways around our checks.
- Post or send unlawful, abusive or misleading content, or misuse the comments of the videos.
- Click ads on purpose or ask others to.
7. Ending the contract
- You may stop at any time and delete your account in the app (Settings, Delete account). See the page “Account and data deletion”.
- We may suspend or close an account, and cancel rewards that come from a breach, if you break these terms or the Rewards Program Rules, if the law requires it, or if we stop the service. We tell you the reason when the law allows it.
- If we stop the app, you can withdraw an available balance above the minimum before it closes, where this is technically possible.
8. Availability
We work to keep the app running but do not promise that it is always available or free of errors. We may pause it for maintenance.
9. Liability
We are liable without limit for intent, gross negligence, injury to life, body or health, and where the law does not allow a limit. For slight negligence we are liable only for the breach of an essential duty and only for the damage that was typical and foreseeable. We are not liable for the lost gain of a reward that was never confirmed. Your mandatory consumer rights stay.
10. Changes to these terms
We may change these terms for a good reason, for example a change of law, of a partner or of the service. We tell you in the app before it takes effect. If you do not agree you can delete your account; if you keep using the app after the date, the new terms apply.
11. Law and courts
Austrian law applies, without its rules on conflict of laws, and the UN sales law does not apply. If you are a consumer, the mandatory consumer protection rules of the country where you live stay in force, and you may sue us where you live. The place of jurisdiction for other users is Vienna, Austria.
12. Contact and complaints
contact@playnexa.eu. If we cannot solve a complaint, you may also use the dispute resolution body that applies in your country.
13. Parts that stay valid
If one part of these terms is not valid, the others stay in force.
